FUELSTAT® SOLUTION AGREEMENT
Conidia may have entered into an agreement with the organisation you work for (Organisation) for the use of the FUELSTAT® Solution (FUELSTAT® Solution Agreement). Please note that the information that your Organisation or you provide to us (whether it is personal or non-personal data) will also be governed by the FUELSTAT® Solution Agreement. If you have any queries about the processing carried out by your Organisation or your rights in respect of such processing, we recommend that you check your Organisation’s privacy policy.
DATA WE COLLECT FROM YOU OR ABOUT YOU AND OUR SOURCES OF THAT DATA
We will collect the following data about you:
Data you give us. You may give us data about you:
- by filing in forms on the FUELSTAT® Solution or the Website, for example if we or your Organisation create a user profile for you to enable you to access the FUELSTAT® Solution and any other services provided by us to your Organisation under the FUELSTAT® Solution Agreement (whether on a trial or full basis);
- when you use the FUELSTAT® Solution (for example, when you enable push notifications or upload data);
- when you transmit or upload content (for example, photographs of completed tests to obtain test results);
- if you sign up to receive marketing communications about us, the FUELSTAT® Solution and other products or services we offer;
- if you complete a survey, for example, about the FUELSTAT® Solution or the Website;
- when you provide us with feedback, opinions and / or comments regarding the FUELSTAT® Solution or Website;
- when you give us access to your camera and photos (if you have enabled this function on your device by updating your settings); or
- if you contact or correspond with us (for example, by phone, e-mail or otherwise) for any other reason (for example, to request further services from us).
Data we collect about you. We will automatically collect the following:
- when you use the FUELSTAT® Solution or the Website, details of your usage (including the date, time, location – for example, GPS location data – or duration of the usage). Your GPS location data will only be tracked if you have enabled this function on your device by updating your settings;
- if you visit the FUELSTAT® Solution or Website, certain technical information, for example the type of device (make, model and its unique device identifier) you use to access the FUELSTAT® Solution or Website, the Internet protocol (IP) address used to connect your device to the Internet, your login information, browser type and version, time-zone setting, browser plug-in types and versions, operating system, mobile network information and platform; or
- information about your visit to the FUELSTAT® Solution or Website including the full Uniform Resource Locators (URL), clickstream to, through and from the FUELSTAT® Solution or Website (including date and time), pages you viewed, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.
Data provided by the Organisation. Your Organisation will give us information when:
- signing up to the FUELSTAT® Solution to enable us to create a user profile for you (if you are an administrator) in order to give you access to the FUELSTAT® Solution under the FUELSTAT® Solution Agreement (whether on a trial or full basis) and to allow an administrator to create your user profile (if you are not an administrator) in order to give you access to the FUELSTAT® Solution.
Data we receive from other third parties or publicly available sources. We may receive personal data about you from various third parties and public sources, for example:
- from your organisation when we instruct the organisation to provide a service, or when the organisation introduces itself to provide a service or supply of products; or
- when you or your organisation get recommended to us for the provision of services or supply of products, or otherwise from publicly available sources when we consider instructing a service provider or supplier.

Where we need to collect personal data by law or as part of a contract we have with you and you fail to provide that data when requested, we may not be able to provide you with the FUELSTAT® Solution or the Website.
Where we have a legal basis to use your personal data without consent (as we have described above), this policy fulfills our duty to process personal data fairly and lawfully and in a manner that you would expect given the nature of our relationship with you, by giving you appropriate notice and explanation of the way in which your personal data will be used.

MARKETING

We will only provide you with marketing communications if you would like us to. You can tell us by ticking the relevant boxes when you first access the FUELSTAT® Solution (whether via the web portal or the app) or by updating your account settings.

We will not provide your personal data to other businesses so they can use it for marketing purposes.

- any member of our group of companies, including our subsidiaries and ultimate holding company;
- service providers (for example, IT services), business partners, suppliers and sub-contractors;
- analytics and search engine providers that assist us in the improvement and optimisation of the Website or the FUELSTAT® Solution;

WHERE WE STORE YOUR PERSONAL DATA
Your personal data will be transferred to, processed and stored within the countries comprising the European Economic Area (EEA) and the United Kingdom.
Whenever we transfer your personal data outside the EEA and the UK, we ensure that a similar degree of protection is afforced to it by ensuring that at least one of the following safeguards is implemented:

The FUELSTAT® Solution can be accessed (and the app downloaded or streamed) and used worldwide, which means that if you or your Organisation are based outside the EEA or United Kingdom your data may be processed outside the EEA and United Kingdom. Please note that the country from which you are accessing personal data may not provide an adequate level of protection for your personal data.
SECURITY
All information you provide to us is stored on secure servers. We will use appropriate technical and organisational measures to safeguard your personal data.
If you are an end user and we have given you (or you have chosen) a password which enables you to access the FUELSTAT® Solution, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
We maintain and ensure that anyone we share your personal data with maintains, appropriate technical and organisational measures to ensure that an appropriate level of security in respect of all personal data we process. Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted via the FUELSTAT® Solution; any transmission is at your own risk. Once we have received your personal data, we will use strict procedures and security features to try to prevent unauthorised access or inadvertent disclosure.
RETAINING PERSONAL DATA
We will retain the personal data we receive or collect about you for the period reasonably required for us to use it in accordance with this privacy and cookies policy or in accordance with our legal rights and obligations (for example, any legal, regulatory, tax, accounting or reporting requirements). To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.
In some circumstances we may anonymise your personal data so that it can no longer be associated with you, in which case we may such information without further notice to you. Even if you request that we erase your data, we may still need to keep it (please see below) or may keep it in a form that does not identify you. If we are processing your personal data as part of a FUELSTAT® Solution Agreement and you have not agreed that we may use your data for marketing purposes, we will retain your personal data on record for no more than the duration of the FUELSTAT® Solution Agreement and 6 years thereafter. Please contact your Organisation directly for details of the duration of the FUELSTAT® Solution Agreement.
YOUR RIGHTS
You have the following rights with regard to your personal data:
- Access. You have the right to access data we hold about you. This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
- Correction. You have the right to request that we correct the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
- Erasure. You have the right to request that we delete any personal data that we hold about you (unless we have the legal right to retain it). If you request that we erase any personal data that we require in order to provide the FUELSTAT® Solution or the Website to you, you may no longer be able to use it. This right does not extend to non-personal data. It is likely to be necessary for us to retain your personal data to enable us to carry out our contract with you and your rights under applicable law to request erasure may be limited accordingly.
- Data portability. You have the right to obtain personal data we hold about you, in a structured, electronic format, and to transmit such data to another data controller if the legal basis for processing such personal data is consent or performance of a contract with you.
- Restriction. You also have the right to restrict us from processing your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
- If you want us to establish the data’s accuracy.
- Where our use of the data is unlawful but you do not want us to erase it.
- Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
- You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
- Object / Change of preferences. You have a right to request that we stop processing your personal data where we are relying on a legitimate interest (or those of a third party). You also have the right to object where we are processing your personal data for direct marketing purposes. Please note that if you ask us to stop processing your personal data in a certain way or erase your personal data, and this type of processing or data is needed to facilitate your use of any Website of the FUELSTAT® Solution you may not be able to use the Website or the FUELSTAT® Solution as you did before, or at all.
